General Business Conditions

GENERAL INFORMATION
Following conditions are valid for all contracts, deliveries and other services. Deviations - also on account of deviating general business conditions of the customer - need the explicit written confirmation. Our offers are not binding and remaining. All illustrations, drawings, measures and weights that are contained in schedules of prices, catalogues and other medias are not binding Information.
An order is regarded as accepted provided that he is not refused by us within two weeks after the arrival to us. Sufficient is the dispatch of refusal within the period of time, where the date of the postmark is decisive.
The representation of the contents occurs after current know- how. Reserved changes. Error concerning the marking as well as the price marking is not excluded.

PRICES
The prices are remaining and are valid from the warehouse in Munich included the transportation and wrapping costs. With appearance of the next price list, the previous price list becomes invalid. All prices are shown in Euro and are including the respective valid value added tax.

PRICE ADJUSTMENT
If our costs rises unforeseeable between the contract conclusion and the delivery by changes from freights, exchange rates, public deliveries of the government conditions, we are authorized to financial to increase the price in accordance with the additional costs.

SHIPMENT
We choose the most favourable dispatch way for you. Instalments are, so far not avoidably, permissible. The delivery time occurs fundamentally as fast as possible, except for fixing dates confirmed in writing. We reserve for us an increase of dispatch charges investment if a supply occurs for technical reasons in several parts. In the case of a sending back, the sender bears the costs and the dispatch risk. Unstamped shipments can not be accepted and will be sent automatically back to you. In the case of an authorized sending back the used postage is compensated to you.

RIGHT OF REVOKE
Per catalogue, letter, e- mail or by telephone commanded products can be given back within 14 days. The costs of the sending back are undertaken by us from a purchase order value of DM 80,-. We refer that the customer has to stick for negligent or deliberate harms of the sent product.

PAYMENT
Target: immediately by C.O.D. without cash discount. Other payments only with written declarations.

OWNERSHIP
The purchased product remains up to the complete equilibrium of the demands our estate. The reservation of proprietary rights also exists for all demands that we acquire against the customer in connection with the purchasing object, e.g. on account of repairs or replacement part deliveries as well as other services. If the customers are a businessman, where the contract belongs to the company of his business, the reserved ownership is also valid for the demands, that we have from the current business relation with this customer.
We are obliged to request of the customer for the renunciation of the reserved ownership when the customer has fulfilled all demands concerning the purchasing object and an appropriate protection exists for the remaining demands from the current business relation.
For that time the reserved ownership exists pledges or sales are only permitted with our written approval.
During the griping of a third party, in particular in the case of the seizure of the purchasing object, the customer has to write a message for to and to refer the third party to our reserved ownership.

RESPONSIBILITY
Rights to compensation because of delay, impossibility of service, injury to contractual and legal duties, fault at contract end and gold sera contractual liability are impossible, as far as the damage was not caused by negligent or deliberate actions of us. Our liability, professional mounting presupposed, is limited to the height of the contracted price.
Claims for compensation according to § 463, 480 II and § 635 BGB (German Civil Law) may stay untouched.

PLACE OF PERFORMANCE/VENUE
Place of performance of the delivery and payment is Munich, Germany.
If the customer is a businessman, a legal person of the public right or a public-legal special property, Munich is arranged with him as venue.

FINAL REGULATION
As far as individual definitions of our general information business conditions are invalid, they are to be replaced corresponding. The validity of the remaining determinations is not osculated from this.

WARRANTY
RooS Racing warrants its products according to its warranty police, respectively to the laws of the country you live in and that apply. In case you have a warranty claim, please contact us first on how to proceed. Please contact us directly, and we will solve the problem together.
However, in order to decide on warranty claims, we will always need the defective product with us, in order to decide.
